1. Introduction

These Terms and Conditions ("T&Cs") govern the use of the dojoHUB app, the dojoHUB website, and the dojoHUB online store, which are operated by Okawa AG, Römerstrasse 36e, 5400 Baden, Switzerland, under the brand name dojoHUB.

If you do not agree to these T&Cs, you are not permitted to use the dojoHUB app, visit the website, or purchase products from the online store. By using our services, you agree to these terms.

These Terms shall be governed by and interpreted in accordance with the laws of Switzerland, without regard to conflict of law principles.

2. Registration & Account

Users must create a dojoHUB account to access content in the app. This also applies to free usage.

Users must provide accurate and truthful information. The creation of fake profiles or accounts for non-existent persons is prohibited.

Users under the age of 16 are only permitted to use dojoHUB with the consent and supervision of a parent or legal guardian. It is the sole responsibility of the parent or guardian to ensure that registration and usage comply with applicable laws regarding minors.

dojoHUB does not actively verify age during registration but reserves the right to request confirmation of parental consent if we become aware that a user may be underage. Parents or guardians may contact us at any time to review, manage, or delete their child’s data.

By allowing a child under 16 to use the dojoHUB app, the parent or legal guardian agrees to these Terms on behalf of the minor and assumes full responsibility for their use of the platform.

Okawa AG assumes no responsibility for the use of the app by minors and disclaims all liability if content is misunderstood or improperly applied.

dojoHUB reserves the right to suspend or delete accounts in the event of a violation of these T&Cs.

3. Use of Content & Copyright Protection

All videos, training content, and materials are the intellectual property of Okawa AG and may not be downloaded, copied, reproduced, or distributed. This includes screen recordings or other technical methods of duplicating content.

Content is for personal use only. Any commercial use, publication, or distribution to third parties is strictly prohibited.

Misuse of our content may be prosecuted under criminal law.

DMCA Takedown Clause (Protection Against Content Theft):

• If dojoHUB content is illegally published or copied, Okawa AG may file a takedown request under the Digital Millennium Copyright Act (DMCA) or other applicable international copyright laws.
• Unauthorized content will be reported for removal and legal action will be taken against copyright infringements.

Misuse includes, but is not limited to: unauthorized sharing of content, commercial use, redistribution, screen recording, or embedding dojoHUB content on other platforms.

To report a copyright violation, please contact us at: legal@dojohub.app. Include a description of the alleged infringement, a link (if available) and your contact information.

4. Subscriptions & Payments

dojoHUB offers the following subscription plans:

• 1-month subscription with unlimited access to all content.
• 3-month subscription with unlimited access to all content.
• 12-month subscription with unlimited access to all content.
• The free version provides limited access to content.

Subscriptions are non-refundable unless required by law. All paid memberships automatically renew unless cancelled before the end of the term or switched to another plan.

Refunds will only be issued in cases where required by consumer protection laws (e.g., EU Directive 2011/83/EU on Consumer Rights) or platform-specific policies (Apple App Store / Google Play Store).

After canceling a subscription, the account remains active, allowing users to resubscribe later.

Payments are processed through Apple App Store (iOS) or Google Play Store (Android). The respective store's terms and conditions apply.

Users are responsible for managing their subscription through Apple App Store (iOS) and Google Play Store (Android). dojoHUB cannot cancel, refund, or adjust subscriptions made via third-party stores.

4.1 Account Deletion

Users can delete their accounts at any time, but all stored data (e.g., favourites, training progress, profile information) will be permanently lost.

Alternatively, users may also contact us directly by sending a request to contact@dojohub.app, and we will process the account deletion on their behalf.

4.2 Account Suspension & Termination:

dojoHUB reserves the right to suspend, restrict, or permanently terminate user accounts that:

• Violate these Terms or Community Guidelines
• Engage in fraudulent or illegal activity
• Misuse content or abuse platform features

Users will be notified in case of suspension or termination, unless dojoHUB determines that prior notice would result in harm or interference.

If an account is suspended by dojoHUB, the active subscription will be immediately terminated without a refund and it will not be automatically renewed.

5. Coupons & Promotions

dojoHUB may occasionally distribute coupons or discount codes via the app, website, or external channels (e.g., social media, newsletters).

Coupons are non-transferable and may not be resold or used for commercial purposes.

The specific terms for redemption will be communicated within the respective promotion or on the website.

Coupons are valid only in the regions and currencies explicitly stated in the promotion. dojoHUB reserves the right to void coupons used outside their intended jurisdiction.

5.1 General Restrictions for All Coupons

• Redeemable only once per user.
• No cash payout or retroactive application to existing subscriptions or purchases.
• Coupons cannot be combined unless explicitly stated otherwise.

5.2 Swiss Launch Offer

The dojoHUB Swiss Launch Promotion offers an exclusive 20% discount on all membership plans and is valid under the following conditions:

• The offer is available only to users residing in Switzerland.
• The promotion is valid for a limited time: iOS until August 14th, 2025 / Android until August 21st, 2025.
• The discount applies to all membership tiers available in the dojoHUB app.
• This offer cannot be combined with other discounts or promotional codes.
• Memberships purchased through this offer are non-refundable, even if cancelled before the end of the active term.
• Subscriptions will automatically renew at the regular full price unless cancelled before the renewal date.

5.3 Global Early Bird Promotion

The dojoHUB Global Early Bird Promotion offers a 15% discount on any membership plan under the following conditions:

• The offer is available to the first 100 new users worldwide who successfully subscribe to a dojoHUB membership.
• Only first-time subscriptions are eligible. Existing or already active memberships do not qualify for this discount.
• The promotion is valid for a maximum of three (3) weeks from the date of global launch or until all 100 discounted memberships are claimed — whichever comes first.
• This offer cannot be combined with other discounts or promotional codes.
• Memberships purchased through this offer are non-refundable, even if cancelled before the end of the active term.
• Subscriptions will automatically renew at the regular full price unless cancelled before the renewal date.

Please note: Due to currency exchange rates, regional pricing systems, and rounding differences, the effective discount may vary slightly from the exact 15% depending on your local currency.

dojoHUB reserves the right to modify or disable coupons at any time without prior notice in case of misuse.

6. Limitation of Liability

To the maximum extent permitted by law, dojoHUB and Okawa AG are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

• Loss of data
• Loss of profits
• Injury or harm resulting from app usage or reliance on training content
• Inaccessibility of the app due to technical issues dojoHUB services are provided "as is" and "as available" with no warranties or guarantees of any kind.

7. Device Compatibility

dojoHUB is optimized for the latest versions of major mobile operating systems. However, we do not guarantee full functionality on all devices, screen sizes, or OS versions.

Some features may require updated software or specific hardware capabilities. dojoHUB is not responsible for issues related to device incompatibility.

8. Third-Party Services

dojoHUB may use or integrate with third-party services such as Apple App Store, Google Play Store, Microsoft Azure, MUX, or external content providers.

dojoHUB is not responsible for the availability, content, or policies of these third-party services. Users should refer to their respective Terms of Use and Privacy Policies.

9. dojoHUB-Onlineshop

Users can purchase physical and digital products via the online store.

Purchase agreements are entered into with Okawa AG.

Payment terms: Ordered goods must be paid for within 30 days. Late payments may be subject to reminder fees.

9.1 Right of Withdrawal

• Subscriptions and digital products are excluded from the right of withdrawal.
• Physical products may be returned within 14 days of receipt, provided they are unused, in their original packaging and in perfect condition.
• The withdrawal request must be made in writing via email or the website contact form.

9.2 Warranty

• Legal warranty rights apply to defects in delivered products.
• The legal warranty period for physical products is 2 years from the date of delivery, as per EU consumer law. This applies to material or manufacturing defects.
• Damage caused during shipping or delivery is not covered under this warranty. In such cases, users must contact the delivery service provider directly to initiate a claim.
• Warranty does not apply to damage resulting from improper use, normal wear and tear, or unauthorized modifications.

9.3 Returns & Refunds

• Buyers may return unused goods within 14 days of receipt.
• Return shipping costs are the responsibility of the buyer.
• Refunds will only be issued after receipt and inspection of the returned item.

10. User Conduct

Users agree not to misuse the dojoHUB platform, including but not limited to:

• Spamming, offensive behaviour, or harassment
• Attempting to reverse-engineer, disrupt, or exploit system vulnerabilities
• Sharing login credentials or allowing multiple individuals to use one account
• Using automated tools to scrape, download, or replicate dojoHUB content

dojoHUB reserves the right to terminate accounts that violate community standards or terms.

11. Fair Use

dojoHUB reserves the right to limit access, throttle bandwidth, or suspend accounts that generate unusually high traffic volumes, consume excessive system resources, or engage in behaviour that negatively affects platform performance or cost-efficiency. This includes, but is not limited to, continuous streaming or behaviour resembling automated access.

These limitations are in place to ensure fair access for all users and to maintain the integrity of the dojoHUB platform.

12. Data & Privacy

By using dojoHUB, users agree to the collection and processing of personal data as outlined in our Privacy Policy.

Data is used for the purpose of:

• User account management
• Training progress tracking
• App improvement and analytics
• Communication (e.g., newsletters, push notifications)

13. Health Disclaimer

dojoHUB provides educational content related to physical training, fitness, and martial arts. This content is not a substitute for professional medical advice, diagnosis, or treatment. Users should consult a physician or healthcare professional before starting any new exercise program.

By using dojoHUB, you confirm that you are physically able to participate in such activities and understand that all training is done at your own risk.

dojoHUB and Okawa AG are not liable for injuries, health issues, or any adverse outcomes that result from the use or misuse of app-based content.

14. Model Arbitration Clause

Any dispute, controversy, or claim arising out of, or in relation to, these Terms — including regarding the validity, invalidity, breach, or termination thereof — shall be resolved by arbitration in accordance with the Swiss Rules of International Arbitration of the Swiss Arbitration Centre, in force on the date the Notice of Arbitration is submitted under those Rules.

The number of arbitrators shall be one.

The seat of arbitration shall be Zurich, Switzerland.

The arbitral proceedings shall be conducted in German.

15. Changes to the Terms & Conditions

Okawa AG reserves the right to amend these T&Cs at any time. Users will be notified of changes via email or in the app.

Privacy policy

1. What Data We Collect

1.1 Personal Data

Username, email address, rank, subscription details.

1.2 Usage Data

Viewed content, favourites, video playing progress.

1.3 Website Data

Essential & analytics cookies to improve the user experience.

1.4 Third-Party Services

dojoHUB uses Matomo Analytics for analytics, Microsoft Azure & MUX for data storage and Apple App Store (iOS) and Google Play Store (Android) for in-app purchases (subscriptions).

2. In-app purchases

All purchases made within the dojoHUB app through the Apple App Store (iOS) or Google Play Store (Android) are subject to the respective store's Terms & Conditions. dojoHUB has no control over the payment process, billing, or refunds for in-app purchases. Any payment disputes or refund requests must be directed to Apple or Google according to their respective policies.

3. Data Storage & Security

All data is the property of Okawa AG.

Data is not sold to third parties.

The servers (Azure & MUX) are used solely for providing the app and website.

Data may be subject to different data protection laws depending on the server location.

Data is stored in compliance with applicable data protection laws, including the Swiss Data Protection Act (revDSG), GDPR, and where applicable, CCPA.

4. User Rights (International Data Protection Laws)

4.1 GDPR (EU Users)

Right to data portability & deletion.

Right to lodge a complaint with a data protection authority.

4.2 CCPA (California, US)

Right to know what data is collected.

Right to request deletion of personal data.

5. Privacy Protection for Children & Adolescents

The dojoHUB app is not specifically designed for children under 16 years old, but it can be used by teenagers.

Users under 16 years old may only use the app with parental consent.

5.1 COPPA & GDPR-K Compliance (Child Privacy Protection)

• dojoHUB does not knowingly target or market to children under the age of 13. While the content within the dojoHUB app is age-appropriate, non-violent, and educational, usage by children under 13 must occur only under the supervision and with the consent of a parent or legal guardian, in accordance with the Children's Online Privacy Protection Act (COPPA) in the U.S. and GDPR-K in the EU.
• dojoHUB does not collect personal data from children under 13 without parental consent (COPPA compliance for the USA).
• In the EU, children under 16 may only use the app with parental approval (GDPR-K compliance).
• By purchasing the app, the user confirms that he:she is the parent or legal guardian of any child using the app and have provided the necessary consent for the collection and processing of their personal data.
• Parents or guardians may request the deletion of their child's data by contacting dojoHUB at legal@dojohub.app. Account data will be removed within 30 days upon request.

6. Data Deletion

Users can delete their accounts at any time.

The deletion of the account cannot be reversed once confirmed and processed.
